Body-Worn Camera Public Records Release Policy


The debate on whether or not to release body-worn camera video continues across the country. A change of attitude from "trying to find every reason not to release" to "releasing everything unless there is a clear legal exemption" is beginning to take hold. As this shift occurs, agencies should seriously consider publishing their BWC records release policy on their agency website as well as a detailed explanation on how the request process works. This is the agency's responsibility and commitment to "transparency". Unfortunately, more and more, we are seeing local and state governing bodies step in and direct the requirement to release and the process for doing so when the agency does not, or will not, make the decision.
